Opportunities for VAT refund for many businesses following EMI VAT case

Following a lengthy process, the European Court of Justice (ECJ) has ruled in favour of EMI in a case about the VAT treatment of providing samples and gifts free of charge to DJs, promoters and the media in order to promote an artist. The legal proceedings began when EMI contested £3.3m pounds it paid in VAT on promotional material issued between 1987 and 2003

Currently, UK law obliges VAT to be accounted for and paid in the event that more than one sample CD is given to the same person. Furthermore, there is a £50 cap on the value of gifts a business can give to an organisation without incurring an obligation to account for VAT.

The ECJ found in favour of EMI by ruling that no VAT is due on sample products irrespective of the amount given to one individual. Also, the threshold value for business gifts should apply per individual rather than per entity.

The finding will force the UK and several other Member States to amend how they treat samples and business gifts given to organisations from a VAT perspective.

It is a significant decision and will impact many businesses located in both the UK and in the EU which provide samples or gifts of small value.

Businesses who have accounted for VAT and have not reclaimed the applicable VAT on samples or gifts should submit retrospective claims as soon as possible to maximise their VAT refund.

Eva Porter

Cork’s newest singer-songwriter, Eva Porter, has just released her debut album, “Heart on My Sleeve”. The busy mother of three made the decision to record some of her finest tracks after some encouragement from her six-year-old son.

Eva has been writing songs since the age of twelve and has always had a passion for music but never took it further than home.

It was only when her then 6 year old son told her on a drive home one night, after they had been singing along to a song Eva had written, that he thought his mum should make a record, that Eva decided to give it a go.
18 months ago the journey from singing her songs to her children to sharing them on her debut album “Heart on my Sleeve” began in earnest.

It started with a phone call to Eva’s uncle, Cork singer and soon to be co-writer, Joe Corbett. Over the next year, Eva and Joe collaborated on the songs for the album.

Brian Connor, Belfast keyboard player and producer whose credits include albums for Freddie White and Albert Niland, heard Eva’s demos and signed on as producer. Brian played keyboards on the album and assembled a line up of Ireland’s finest musicians to join him – Johnny Scott, guitarist, Rod Patterson, bassist and Danny Byrt, percussion. The album was recorded in Sonas Studios, Glenflesk, Co. Kerry in December 2009. The album was engineered by Tony O’Flaherty of Sonas Studios and mastered by Ruairi O’Flaherty.

Eva’s music reflects her wide range of musical influences and love of folk, country and soul.
“Heart on my Sleeve” was launched on Thursday 17th June at the Boardwalk Bar & Grill, Cork. You can find out more about Eva at her website www.evaporter.com.

JIMI HENDRIX MURDERED? “NOT IMPROBABLE” SAYS NOEL REDDING…

The name Jimi Hendrix conjures up some of the most colourful and wildest moments that the sixties produced. Hendrix arrived, he conquered and took the music world  by storm, got inside your head and went onto the great gig in the sky  – all by the age of 27.

The Jimi Hendrix Experience, left you in no doubt that it was exactly that – an experience. A trio of musicians who came together from both sides of the Atlantic and found common ground, fame and for one third of the group not very much fortune.

For Noel Redding the bass player in the group the experience was not to be forgotten. Since the death of Hendrix 40 years ago, much has been documented about him and the group.

Looking back to the sixties and you could be thinking you are on another planet. Any history  relating to that period is taken up with music and culture. The Jimi Hendrix Experience played it`s part.

Making a timely appearance is a DVD that is being put out by MNV Discs International, containing a never before seen interview with Noel Redding recorded at his home in Ireland in 1988.

It  makes fascinating viewing.   All the years of  seeing film of them in  concert and photographs of Hendrix, Redding and Mitchell, you find yourself sitting in a living room not with just a legend – but an ordinary guy talking about his early days with the group. No rock star here, no pretentious name dropping, just plain talking. Listening to him you are left wondering how they made it to top.

I asked producer Will Scally who had the foresight to record this interview how it all  came about.  “ I had known and been friends with  Noel for many years and always found him a very upfront, straightforward guy. We often spoke about doing an interview, he wanted to speak about the band, money, drugs and the death of Hendrix and much more – even speaking about the possibility of Hendrix being murdered. He was on good form that day and  wanted to record this for posterity.

Sadly Noel Redding died back in 2003 aged 57

For those interested in Hendrix, Redding and the history of sixties rock music this rare visual documentary should not be missed.

New Editor at The Journal of Music

The Journal of Music has just announced Benedict Schlepper-Connolly as its new Editor. The change happens as the magazine enters an exciting new era, with its redevelopment into a major digital publication in 2011. Schlepper-Connolly, also a composer and producer, has been with the magazine since 2007, most recently as Deputy Editor. A director of the music company Ergodos, which he co-founded in 2006, his work has been performed by Resurgam, Crash Ensemble as well as his own ensembles. Having studied music at Trinity College, in the United States and Germany, Benedict now lives between Dublin and Berlin.

Commenting on his appointment, Schlepper-Connolly said, “It's exciting to be leading an important publication such as The Journal of Music into new terrain. With the launch of our new online version in 2011 the capacity for a profound engagement with our community is unprecedented, and the audience for music and ideas greater than ever.”

The Journal of Music was founded in 2000 by musician Toner Quinn, who edited the magazine to this year. For these ten years it was published as a bimonthly print edition, with a growing online presence. After winning the UTNE Independent Press Award for Arts Coverage in 2010, the decision was made to remodel the magazine as an online publication, with a more occasional print edition.

Quinn, who continues to be involved in the magazine as Publisher, spoke of his decision to step back from the editorship: “When I started the Journal in November 2000 I had no plan beyond the second issue. After ten years of publishing the most wonderful writers and thinkers on music, I believe it is time for a change. While still involved as Publisher, I also want to develop other projects. A change of editor is a healthy event in the life of a publication. Benedict is someone who understands the magazine and its readers intimately, and I am certain that this change will bring a fresh look at the world of music, while maintaining our high editorial standards.”

The popular promoter, manager and fondly loved raconteur Derek Nally died of a heart attack on Thursday 15 July, 2010. His sudden passing sent shockwaves throughout the entire Irish music community.

Derek worked with the great and the good over the years including Judy Collins, Kate and Anna McGarrigle, Bert Jansch, John Cale, Guy Clarke, Townes Van Zandt, John Martyn, Allen Toussaint, Ian Dury & the Blockheads, Alex Chilton, Arlo Guthrie, Booker T, and John Cooper Clarke, to mention just a few.  He also managed the acclaimed Irish acts Juliet Turner and Ham Sandwich, steering their careers with remarkable passion and enthusiasm. Derek was particularly generous with his time when it came to offering advice to up and coming musicians, promoters and managers. His encyclopedic knowledge of music coupled with his straight-forward business ideals served him well in a long and esteemed career. His legacy is a positive example to everyone who works in the music industry.

The band Derek was most closely associated with Ham Sandwich and numerous other friends from the music community will together on December 22nd in memory and celebration of this legendary figure.

HAM SANDWICH:
The Kells-based band released their second album "White Fox", the follow-up to their 2008 award winning debut long-player "Carry the Meek", in October 2010. A glimpse of what was to come appeared on the nation's airwaves back in May which raised the bar of expectations for the much anticipated new album; the "The Naturist" announced to the fanbase that the band were pushing the boat out and not resting on their laurels!
“We've definitely grown up since ‘Carry The Meek',” maintains Niamh. “In terms of all of us getting involved in the song writing process and, I suppose, just maturing as people. Making the song structures more interesting is crucial for both the listener and the band, because it holds the attention for longer.” Podge recounts, "The first album was practically all electric guitar; the new album is more musically varied – and not for the sake of it, either. It's just that we're getting our heads around different instruments. It's a natural evolvement, and more texture is no harm.”

Produced and mixed by Karl Odlum and recorded at Sun Studios, Temple Bar (Dublin) & May Lodge (Co. Meath). Mastered by the legendary Abbey Road Studio (London) engineer Peter Mew (David Bowie, The Beatles, ELO, Bob Marley, etc)

The band will be playing a special night in Whelan’s dedicated to their late manager Derek Nally on the 22nd of December. Derek meant a great deal to the band and was a major part in helping them bring their music to the foreground in Ireland. The band will be joined on the night by special guests, as well as sets from The Gandhis, Pugwash, Blink and more special guests yet to be announced. All proceeds will go to The Nally family.
