Directive on Copyright in the Digital Single Market, patents: case law update and trademarks: recent developments

Aim and Objectives

The Aims and objectives are to update practitioners in recent developments in intellectual property law. The seminar includes an opportunity to hear a discussion of the implications of the Copyright Directive in the Digital Single Market from a panel of experts in the area. There is also an update in patent case law and a practical guide to handling unauthorised on-line trade mark use disputes. The seminar is relevant to all practitioners who have involvement in intellectual property law.

Topics include:

• Directive on Copyright in the Digital Single Market: An outline of the main issues and the implications for copyright holders arising from implementation on 7 June;
• Patents: recent Irish cases on preliminary injunction
• Trade Marks: practical update on handling unauthorised on-line Trade Mark Use Disputes:
  • unauthorised on-line trade mark use and dispute resolution strategies;
  • Example cases: (a) unauthorised key word advertising; (b) fake commercial website; (c) fraudulent social media handle
    • The future of on-line trade mark disputes under the proposed European “Digital Services Act”

Learning Outcomes

On completion of the seminar participants will have a knowledge and awareness of:

• the main issues and implications arising from the implementation of the Directive on Copyright in the Digital Single Market;
• recent Irish patent cases on preliminary injunction, and
• How to handle unauthorised on-line trade mark use
